- User refers to any individual or entity that accesses or uses the Platform.
- Account refers to the registered profile created by a User to access features of the Platform.
- Content refers to all text, video, audio, images, data, and other materials available on the Platform.
- Masterclass refers to any online course, instructional session, or educational program offered through the Platform.
- Instructor refers to any recognized professional who delivers educational content on the Platform.
- Subscription refers to any paid access plan that grants Users access to Platform features or Content.
2. Acceptance of Terms
By creating an Account, enrolling in a Masterclass, or otherwise using the Platform, you agree to these Terms of Use and our Privacy Policy. These terms form a binding legal agreement between you and Malthiosys.
We reserve the right to update or modify these Terms of Use at any time. Continued use of the Platform after changes are published constitutes your acceptance of the revised terms. It is your responsibility to review these terms periodically.
3. Eligibility
You must meet the following criteria to use the Platform:
- You must be at least 18 years of age, or the legal age of majority in your region.
- If you are between 13 and 17 years of age, you may only use the Platform with verifiable parental or guardian consent.
- You must not have been previously suspended or removed from the Platform.
- You must have the legal capacity to enter into a binding agreement.
By using the Platform, you represent and warrant that you meet all eligibility requirements.
4. Account Registration and Security
4.1 Creating an Account
To access most features of the Platform, you are required to register an Account. You agree to provide accurate, current, and complete information during registration. You must keep your Account information up to date at all times.
4.2 Account Responsibility
You are solely responsible for maintaining the confidentiality of your login credentials and for all activities that occur under your Account. You must notify us immediately at help@Malthiosys.sbs if you suspect any unauthorized access to your Account.
4.3 Account Restrictions
Each Account is for a single individual. You may not share your Account credentials with others. Creating multiple Accounts to circumvent restrictions or gain unauthorized access is prohibited.
5. Platform Access and Use
5.1 License Grant
Subject to these Terms of Use, Malthiosys grants you a limited, non-exclusive, non-transferable, revocable license to access and use the Platform for personal, non-commercial educational purposes.
5.2 Permitted Use
You may access and view Content for which you have paid or been granted access. You may download materials only where explicitly permitted by the Platform. You may participate in community features in accordance with our community standards.
5.3 Prohibited Use
You must not:
- Copy, reproduce, distribute, transmit, or resell any Content without prior written authorization.
- Use the Platform for any unlawful purpose or in violation of any applicable laws or regulations.
- Attempt to gain unauthorized access to any system, network, or database connected to the Platform.
- Use automated tools, bots, scrapers, or other means to extract data from the Platform.
- Upload or transmit viruses, malware, or any harmful code.
- Impersonate any individual, Instructor, or entity.
- Engage in harassment, abuse, or any conduct that negatively affects other Users.
- Use the Platform to advertise or promote third-party products or services without authorization.
- Reverse engineer, decompile, or attempt to extract source code from the Platform.
6. Masterclasses and Educational Content
6.1 Enrollment
Enrollment in any Masterclass is subject to availability and applicable fees. Once enrolled, you are granted access to the specific Masterclass Content for the duration specified at the time of purchase.
6.2 Content Accuracy
All Content on the Platform is provided for educational and informational purposes only. While we strive for accuracy and quality, we do not guarantee that all Content is complete, error-free, or suitable for your specific objectives.
6.3 No Professional Advice
Content delivered through Masterclasses does not constitute professional, legal, financial, or technical advice. Users should exercise their own judgment and, where appropriate, consult qualified professionals before applying techniques learned on the Platform.
6.4 Content Updates
Instructors and the Platform reserve the right to update, modify, or remove Masterclass Content at any time without notice.
7. Fees, Payments, and Subscriptions
7.1 Pricing
Fees for Masterclasses and Subscriptions are displayed on the Platform at the time of purchase. All prices are listed in the applicable currency and are inclusive of any applicable taxes unless otherwise stated.
7.2 Payment Processing
Payments are processed through secure third-party payment providers. By providing payment information, you authorize Malthiosys to charge the applicable fees. We do not store full payment card details on our servers.
7.3 Subscription Billing
Subscription plans are billed on a recurring basis as specified during sign-up. Your Subscription will automatically renew unless cancelled before the renewal date. You are responsible for cancelling your Subscription if you do not wish to continue.
7.4 Refunds
Refund eligibility is subject to our Refund Policy, which is incorporated into these Terms by reference. Refunds are generally evaluated on a case-by-case basis and are not guaranteed. Digital products that have been accessed or downloaded may not qualify for a refund.
7.5 Failed Payments
If a payment fails, access to your Subscription or enrolled Content may be suspended until the outstanding balance is resolved. We may attempt to charge the payment method on file multiple times before suspending access.
8. Intellectual Property
8.1 Platform Ownership
All Content, trademarks, service marks, logos, software, and materials on the Platform are the intellectual property of Malthiosys or its licensors. Nothing in these Terms grants you ownership over any Platform property.
8.2 User-Generated Content
If you submit any feedback, comments, suggestions, or other materials to the Platform, you grant Malthiosys a worldwide, royalty-free, perpetual, irrevocable license to use, reproduce, modify, publish, and distribute such content for Platform-related purposes.
8.3 Copyright Infringement
If you believe any Content on the Platform infringes your intellectual property rights, please contact us at help@Malthiosys.sbs with detailed information. We will investigate and respond in accordance with applicable procedures.
9. Third-Party Links and Services
The Platform may contain links to third-party websites, tools, or services. These links are provided for convenience only. Malthiosys does not endorse, control, or assume any responsibility for the content or practices of any third-party sites. Accessing third-party links is done at your own risk.
10. Privacy and Data
Your use of the Platform is also governed by our Privacy Policy, which explains how we collect, use, and protect your personal information. By using the Platform, you consent to the practices described in the Privacy Policy.
11. Disclaimers and Limitation of Liability
11.1 No Warranties
The Platform and all Content are provided on an "as is" and "as available" basis without warranties of any kind, either express or implied. Malthiosys disclaims all warranties, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement.
11.2 Availability
We do not guarantee uninterrupted or error-free access to the Platform. We reserve the right to perform maintenance, upgrades, or temporary outages without prior notice.
11.3 Limitation of Liability
To the fullest extent permitted by applicable law, Malthiosys and its affiliates, officers, employees, agents, and partners shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of your use of or inability to use the Platform, even if advised of the possibility of such damages.
11.4 Maximum Liability
In no event shall Malthiosys's total liability to you for all claims arising from these Terms or your use of the Platform exceed the total amount you have paid to Malthiosys in the twelve (12) months prior to the event giving rise to the claim.
12. Indemnification
You agree to indemnify, defend, and hold harmless Malthiosys, its affiliates, officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses, including reasonable legal fees, arising out of or in any way connected with:
- Your use of or access to the Platform.
- Your violation of these Terms of Use.
- Your violation of any rights of another party, including Instructors or other Users.
- Any Content you submit to the Platform.
13. Termination and Suspension
13.1 By Malthiosys
Malthiosys reserves the right to suspend or terminate your Account and access to the Platform at any time, with or without notice, if you violate these Terms of Use or engage in conduct that we determine to be harmful to the Platform, other Users, or any third party.
13.2 By You
You may terminate your Account at any time by contacting us at help@Malthiosys.sbs. Termination of your Account does not relieve you of any outstanding payment obligations.
13.3 Effect of Termination
Upon termination, your license to access the Platform ceases immediately. Provisions of these Terms that by their nature should survive termination will continue to apply, including intellectual property rights, disclaimers, and limitations of liability.
14. Modifications to the Platform
Malthiosys reserves the right to modify, suspend, or discontinue any part of the Platform at any time without liability. We may change features, remove Content, or alter pricing structures with reasonable notice where possible.
15. Governing Terms
These Terms of Use represent the entire agreement between you and Malthiosys with respect to your use of the Platform and supersede all prior or contemporaneous agreements, representations, and understandings. If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions shall continue in full force and effect.
